TERMS AND CONDITIONS OF THE ONLINE STORE

The owner of the online store www.envi.ee (hereinafter referred to as the “Online Store”) is Enviluxe OÜ (registry code 14476580), with its registered address at Mahtra 66-14, Tallinn, Estonia.

Validity of the sales contract, product and price information

These Terms and Conditions apply to the purchase of goods from the Online Store.

The prices of the products sold in the Online Store are indicated next to the products. Delivery fees are added to the price of the products. All prices displayed in the Online Store are in euros (EUR).

The delivery fee depends on the buyer’s location and the selected delivery method. The delivery fee is displayed to the buyer during the checkout process.

Information about the products is provided in the Online Store directly next to each product.

Placing an order and payment

To place an order, the customer selects the desired products and adds them to the shopping cart. To complete the order, the required information must be entered and a suitable delivery method selected. The total amount payable is then displayed on the screen and can be paid securely using the available payment methods.

The following payment methods are available in the Online Store:

  • bank payments via Estonian banks;
  • Visa and Mastercard card payments;
  • Apple Pay and Google Pay;
  • “Pay later” solutions.

Payments are processed by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment — in the secure environment of the respective bank when paying via a bank link, and in the secure environment of Maksekeskus AS when paying by card. The seller does not have access to the customer’s bank or card details.

The sales contract enters into force upon receipt of the payable amount in the Online Store’s bank account.

The owner of the Online Store is the controller of personal data and transfers the personal data necessary for processing payments to the authorised processor Maksekeskus AS.

If the ordered goods cannot be delivered due to the product being out of stock or for any other reason, the buyer will be informed as soon as possible and the paid amount (including delivery costs) will be refunded without delay, but no later than within 14 days from the date of the notification.

Delivery

Goods are delivered only in Estonia.

The buyer may choose from the following delivery options:

  • parcel lockers and/or courier services provided by the Online Store’s delivery partners.

The delivery costs are borne by the buyer and the relevant price information is displayed next to the selected delivery method during checkout.

Domestic shipments within Estonia generally reach the destination specified by the buyer within 5 business days from the entry into force of the sales contract.

In exceptional cases, the Online Store reserves the right to deliver the goods within up to 20 calendar days.

Right of withdrawal and returns

After receiving the order, the consumer has the right to withdraw from the contract concluded in the Online Store within 14 days.

The right of withdrawal does not apply to legal entities. Due to the nature of cosmetic and personal care products, the right of withdrawal does not apply to products that have been opened, used, or are not suitable for return for health or hygiene reasons after delivery.

In order to exercise the right of withdrawal, the products must be unused, unopened, and in their original packaging. The products may only be handled to the extent necessary to verify their nature, characteristics, and functioning, as would be permitted in a physical retail store.

If the products have been used beyond what is necessary to verify their nature, characteristics, and functioning, or if there are signs of use or wear, the Online Store reserves the right to reduce the refundable amount in proportion to the decrease in the value of the products or to refuse the return.

To withdraw from the contract, the buyer must notify the Online Store by email at info@envi.eewithin 14 days of receiving the goods.

Unless otherwise stated, the costs of returning the goods are borne by the buyer. Return shipping costs are not borne by the buyer if the return is due to an incorrect or defective product.

The buyer must return the goods without undue delay and no later than 14 days after notifying the Online Store of the withdrawal.

Upon receipt of the returned goods, the Online Store shall refund all amounts received from the buyer under the contract without delay, but no later than within 14 days from the date of receiving the returned goods.

The Online Store may withhold the refund until the returned goods have been received or until the buyer has provided proof of return, whichever occurs first.

If the buyer has explicitly chosen a delivery method other than the least expensive standard delivery method offered by the Online Store, the Online Store is not required to reimburse the additional delivery costs.

The Online Store reserves the right to withdraw from the sales transaction and request the return of the goods if the product price has been displayed incorrectly at a significantly lower level due to an error.

Right to submit a claim

The Online Store is liable for any non-conformity or defect of the goods sold to the consumer that existed at the time of delivery and becomes apparent within two years from the date the goods were delivered to the buyer. During the first year from the delivery of the goods, it is presumed that the defect existed at the time of delivery, unless the Online Store proves otherwise.

If a defect becomes apparent, the buyer has the right to contact the Online Store within two months by sending an email to info@envi.ee.

The Online Store is not liable for defects that arise after the goods have been delivered to the buyer.

If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store shall repair or replace the defective goods. If repair or replacement is not possible, the Online Store shall refund all amounts paid under the sales contract.

The Online Store shall respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.

Direct marketing and processing of personal data

The Online Store uses the personal data entered by the buyer solely for processing orders and delivering goods to the buyer. The Online Store transfers personal data to delivery service providers only to the extent necessary for the delivery of goods.

The Online Store sends newsletters and promotional offers to the buyer’s email address only if the buyer has expressly given consent by entering their email address on the website and indicating their wish to receive marketing communications.

The buyer may unsubscribe from newsletters and promotional emails at any time by notifying the Online Store by email or by following the instructions provided in the promotional email.

Dispute resolution

If the buyer has any complaints regarding the Online Store, they should be submitted by email to info@envi.ee.

If the buyer and the Online Store are unable to resolve the dispute by mutual agreement, the buyer has the right to contact the Consumer Disputes Committee (Tarbijavaidluste komisjon). The committee is authorised to resolve disputes arising from contracts concluded between the buyer and the Online Store. Review of complaints by the committee is free of charge for the consumer.

The buyer may also turn to the European Union’s online dispute resolution (ODR) platform for resolving consumer disputes.
